Kakovost zagotavljanja pravic do varnega in zdravega dela
Izvleček
Varno in zdravo delo je danes neločljiv del delovnega razmerja,
ki ima pomemben vpliv na sistem socialne varnosti. Področje varnosti
in zdravja pri delu obsega pravice in obveznosti delavcev
in delodajalcev. Delavci upravičeno pričakujejo, da jim bo zagotovljeno
zdravju neškodljivo delovno okolje in jim bo v primeru
začasne ali trajne nezmožnosti za delo zagotovljena socialna
varnost. V članku preverjamo tezo, da je na področju poklicnih
obolenj socialna varnost kljub zakonsko določenim predpisom v
določenih delih pomanjkljiva. Pravna nedoločenost zakonske ureditve
vpliva predvsem na pravni položaj zavarovanih oseb, tako
glede opredelitve vrste in vsebine pravic in obveznosti, kot tudi
oblikovanja pravnih razmerij, v katera vstopajo. Vpliva tudi na
možnost oblikovanja zahtevka zavarovane osebe pri uveljavljanju
pravic iz pokojninskega zavarovanja. Država mora z ustreznimi
ukrepi zavarovati pravice delavcev.
