Ustavnopravna narava človekovih pravic
Izvleček
Namen članka je analizirati ustavnopravno naravo človekovih
pravic, zlasti preko dognanj moderne pravne dogmatike in najnovejše
pravne prakse, predvsem Evropskega sodišča za človekove
pravice ter Ustavnega sodišča Republike Slovenije. Avtor izhaja iz
načela univerzalnosti človekovih pravic, to pa iz odločbe ICJ v zadevi
Barcelona Traction, ter pravnem efektu erga omnes. Nadaljuje
s problematiko efekta človekovih pravic v njihovem horitzontalnem
(unmittelbare Drittwirkung) in vertikalnem efektu (mittelbare
Drittwirkung). Pri tem izpostavlja specifike Evropskega sodišča
za človekove pravice in dognanja, neposredno povezana z neposrednim
efektom človekovih pravic – pozitivno obveznost države.
Avtor se s fenomenom pravnega efekta v nadaljevanju ukvarja tudi
s specifikami ustavnega prava, predvsem z neposredno aplikabilnostjo
ustavnih pravic v slovenskem pravu. Drugo težišče prvega
dela članka je na suspenzu človekovih pravic na podlagi EKČP in
Ustave RS. Drug del članka pa je osredotočen na funkcije ustavnih
pravic v ustavnem redu RS. Pri tem avtor izpostavlja sledeče:
zaščitniško funkcijo, storilno ter obrambno funkcijo ustavnih pravic.
Slednjo (nem. Abwehrfunktion) razumemo po modernih dosežkih
primerjalnopravne prakse kot zahtevo državni oblasti, da
obrani uživanje ustavnih pravic posameznikov tudi v razmerju do
tretjih (torej tistih posameznikov, ki nimajo oblastvene vloge). V
tem okviru gre v bistvu za celo serijo ustavnopravno zajamčenih
pravic, ki pa se konkretizirajo v kazenskem, upravnem ali civilnem
pravu.
