Ideološki pozitivizem kot metoda ustvarjanja objektivnosti v pravu
Izvleček
Zdi se, da je Hans Kelsen v svoji Čisti teoriji prava (Reine Recht-slehre) končno našel odgovor na vprašanje, iz kje pravo črpa svo-jo moč, kje je resnični izvor prava. Za Kelsna je to temeljna norma (Grundnorm), počelo vseh drugih pravnih norm, ki iz nje izhajajo. Če vzamemo temeljno normo za podstat vseh ostalih, potem seve-da obstanemo na področju človeškega normiranja, ni nam potreb-no iskati tam, kjer se stvari izmikajo človeškemu nadzoru. Kelsno-va teorija, sicer ne zanika obstoja etike in metafizike, a ju vendarle hoče izključiti iz svojega - pravnega področja. Kot bi hotel reči: naj obstajajo še druge norme, vendar naj ne skušajo urejati mojega po-dročja. Temeljna norma je priročen pojem, ki je dovolj abstrakten, da je neoprijemljiv in mu lahko pripišemo poljubno vsebino. Kar pa izdaja njegovo resnično bistvo je njegova normativna moč. Bi-stvena funkcija temeljne norme je namreč funkcija vrhovnega za-konodajalca. Temeljna norma je v resnici drevo spoznanja dobrega in hudega, kar pa ni nič drugega kot človeški razum. Človek je sa-mega sebe postavil na mesto, ki v resnici pripada Bogu. Prvi pogoj za dosego tega cilja pa je bila ločitev biti (Sein) in najstva (Sollen). S tem ko je bivajoče, torej že postavljeno naravno pravo (Sein) odre-zal od pravnega normiranja (Sollen), je tako onemogočil vsakršen vpliv naravnega prava na pozitivno (časno, sekularno) pravo. Na ta način, je Hans Kelsen, vsaj na pravnem področju, človeka očistil ali osvobodil ali odrešil stika z Bogom. Človeštvo si sedaj lahko ustvari povsem svoj svetovni etos in svoje zakone.
