Kritična analiza načela subsidiarnosti in njegov doprinos k demokraciji v Evropski uniji
Izvleček
Prispevek predstavlja načelo subsidiarnosti kot eno izmed pomembnejših načel v Evropski uniji. Sistematično in analitič-no predstavlja uporabo predmetnega načela v praksi in učinke, ki jih lahko ustvari v odnosu med Evropsko unijo in državami članicami. Slednje niso le pasivni del Unije, temveč so, ali vsaj morale bi biti, aktivnejše pri soustvarjanju in oblikovanju prava Evropske unije, kajti ravno načelo subsidiarnosti je tisti varno-stni mehanizem, ki ga države lahko uporabljajo, da zajezijo čez-merno prilaščanje pristojnosti s strani Evropske unije. Pri tem velja poudariti, morda kot najpomembnejše dejstvo, da so iz de-mokratičnega vidika pravni akti Evropske unije nekakovostni. Gre torej za demokratični primanjkljaj, ki ga je moč zaznati v pravnih aktih Unije. Dejstvo, da so države članice ob pristopu k Evropski uniji nanjo prenesle del suverenosti v izvrševanje, še ne pomeni, da pravni akti Unije izražajo voljo državljanov držav članic.
