Pravica do družinskega življenja v praksi Evropskega sodišča za človekove pravice

Izvleček

Namen prispevka je predstaviti analizo sodne prakse Evrop-skega sodišča za človekove pravice (ESČP) v zvezi s pravico do družinskega življenja. Prispevek v prvem delu opredeljuje po-jem družinskega življenja na podlagi dolgoletne sodne prakse. ESČP glede priznavanja družinskega življenja razlikuje med raz-merji, za katere vzpostavlja presumpcijo družinskega življenja ter ostalimi de facto družinskimi razmerji. Med prva se uvrščajo družine, ki temeljijo na formalnih ali krvnih vezeh med ožjimi družinskimi člani. Za ostala razmerja je prisotnost družinskih vezi določena iz dejanskih okoliščin. V drugem delu prispevka so s pomočjo analize primerov opredeljeni zahtevani standardi varstva za posamezna področja, ki so zajeta s pravico do družin-skega življenja ter pravico do »zasebnega in družinskega življe-nja«, in vključujejo; pravno priznanje de facto družinskih raz-merij, nekatere materialnopravne in druge pravice povezane z družinskim življenjem, varstvo družinskega življenja med starši in mladoletnimi otroki, varstvo družinskega življenja tujcev in zapornikov ter pripornikov, varstvo pred nasiljem v družini, varstvo osebnega imena, pravico do pokopa svojcev, pravico do spoštovanja odločitve postati starš in pravico do zdravega ži-vljenjskega okolja. Poglavitni namen pravice do družinskega ži-vljenja je zaščita pred arbitrarnimi posegi v družinsko življenje. Države imajo tudi pozitivne obveznosti, da varujejo družinsko življenje pred razpadom, omogočijo vzpostavitev družinskega življenja ter zaščitijo družinske vezi pred kršitvami s strani za-sebnopravnih subjektov.
