Uresničevanje Listine Evropske unije o temeljnih pravicah v domačih in evropskih pravnih redih

Prispevek raziskuje uresničevanje Listine Evropske unije o te-meljnih pravicah v domačih pravnih redih, pri čemer se v zadnjem delu prednostno posveča njeni (ne)uporabi v slovenskem prav-nem redu. v tej luči članek tudi analizira ali ima Listina kakšno dodano vrednost pri varovanju človekovih pravic na evropskem kontinentu. Po kratkem uvodu v drugem delu opisujemo vsebino Listine in ugotavljamo njen pomen v evropskem pravnem redu. v tretjem delu predstavimo in analiziramo razmerje med Listino in Evropsko konvencijo o varstvu človekovih pravic in temeljnih svoboščin ter kritično analiziramo mnenja Sodišča Evropske unu-je št. 2/13. Četrti del obravnava in analizira postopke in načine pri uporabi Listine na Sodišču Evropske unije. Peti del izpostavlja vprašanje uresničevanja Listine Evropske unije v domačih pravnih redih. Šesti del pa analizira naravo sodniškega odločanja z ozirom na Listino, medtem ko sedmi del obravnava položaj Listine pri so-dnem varstvu človekovih pravic v slovenskem pravnem redu. v za-ključku ugotavljamo, da bo šele prihodnost pokazala, ali je Listina dozorela v avtoritativen dokument, ki ga spoštujejo in uresniču-jejo tako državni kot nevladni organi v domačih in mednarodnih pravnih redih.
