Pravica do odločitve o času in načinu lastne smrti
Izvleček
Upoštevaje diskrecijsko pravico držav podpisnic, način odlo-čanja eSČP v primeru zatrjevanih kršitev pravic varovanih po 8. členu ekČP ter odločitev eSČP sprejetih v primerih Pretty proti združenemu kraljestvu, Haas prošti Švici ter Gross proti Švici gre ugotoviti, da je posameznikova pravica, da izbere čas in način svo-je lastne smrti, kot del pravice do samoodločbe, varovana v okviru pravice do spoštovanja zasebnega življenja po 8. členu ekČP, pod pogojem, da je posameznik sposoben svobodnega odločanja in pod pogojem, da je skladno s sprejeto odločitvijo tudi sposoben ravnati. Državam članicam je naložena pozitivna obveznost, da vzpostavijo ustrezen sistem ukrepov, ki naj prepreči, da bi posa-meznik končal lastno življenje, če taka odločitev ni bila sprejeta svobodno in ne da bi posameznik razumel posledice take odlo-čitve.
