Trajni in neusahljivi temelj slovenske državnosti?

Članek kritično analizira odločitev slovenskega Ustavnega sodišča
o skladnosti arbitražnega sporazuma z Ustavo. Slovensko
Ustavno sodišče je po vzoru tujih sodišč v tem primeru uporabilo
doktrino t. i. neusahljivega epistemičnega bistva pravnega reda, a
je ni privedlo do svojega logičnega zaključka. Slovenska doktrina
neodtujljivega epistemičnega bistva je tako zgolj deklarativna in
se ustavi na obronkih političnega parketa, ki mu Ustavno sodišče
ne upa (ali ne želi) začrtati ustreznih ustavnopravnih mejnikov, pa
čeprav te jasno narekuje – kot to izrecno ugotavlja Ustavno sodišče
– Ustava sama. Kaj potemtakem slednjič ostane od domnevno
trajnih in neusahljivih temeljev slovenske državnosti, ki so utelešeni
v Temeljni ustavni listini, je seveda le še retorično vprašanje.
