Analiza sodbe Meddržavnega sodišča v zadevi Kitolov na Antarktiki (Avstralija proti Japonski: intervencija Nove Zelandije)
Izvleček
Prispevek obravnava sodbo Meddržavnega sodišča Kitolov na Antarktiki (Avstralija proti Japonski: intervencija Nove Zelandi-je), pri čemer predstavi ozadje spora, povzame vsebino odločitve sodišča in razčleni njen pomen, zlasti iz vidika osvetlitve okoliščin, ki dovoljuejo ‘znanstveni kitolov’ ter pojasnjevanja pravnega sta-tusa priporočil pogodbenih teles. Pomemben del v obrazložitvi sodišča zavzema določanje objektivnih pogojev za izvajanje de-javnosti v ‘znanstvene namene’, medtem ko je tokratni prispevek Sodišča k razvoju vsebinskih norm okoljskega prava majhen. Pri-spevek zaključi z oceno o verjetnem razpletu spora in začrta nekaj potez prihodnje pravne ureditve kitolova, glede na družbeno-po-litične okoliščine.
