Residential real estate investments from the perspective of Act on Social Security Benefits
Izvleček
Slovenska populacija se pospešeno stara. z rastjo pričakova-ne življenjske dobe postaja delež socialnih transferjev v javnem proračunu nevzdržen. Da bi lahko družba še naprej vzdrževala vitalno skupnost starostnikov, ponosnih na svojo dolgoživost, je potrebno razviti ekonomske in družbene institucije za izboljšanje nastalega stanja v družbi, ki je posledica njenega staranja. v Evrop-ski uniji so države članice odgovorne za planiranje, financiranje in administracijo sistemov socialne varnosti za starajoče se prebival-stvo. Evropska unija podpira države članice pri pripravi reform in priporoča paralelno zasledovanje treh dolgoročnih ciljev (a) do-stopnost do kvalitetne zdravstvene oskrbe in socialnih storitev (b) izboljšanje kvalitete dolgotrajne oskrbe (c) zagotovitev vzdržnosti financiranja teh storitev. v tem kontekstu je financiranje starajoče se populacije ključno vprašanje. Slovenska vlada se je zaradi naraščajočih stroškov zagotavljanja socialne varnosti odločila, da samo starostnikom, ki niso lastniki nepremičnin in nimajo zadostnih sredstev za financiranje osnov-nih življenjskih stroškov, pripada nepovratna socialna pomoč.Ta zakon določa, da so socialno varstveni prejemki oblika posojila lastnikom nepremičnin, pri čemer ima država pravico, da se ob izdaji odločbe vpiše v zemljiško knjigo kot hipotekarni upnik in vanjo zabeleži prepoved odtujitve nepremičnine. v tem članku bomo predstavili nepravičnost zakona do lastnikov nepremičnin, saj socialno varstveni prejemki niso aktuarsko pošteno odmerjeni, ker ne upoštevajo vrednosti nepremičnine in starosti prejemnika. zakon o socialno varstvenih prejemkih zmanjšuje mobilnost pre-jemnikov in izpostavlja premoženje prejemnikov tveganju padca vrednosti zaradi prisilne prodaje na nelikvidnem slovenskem trgu nepremičnin ob smrti upravičenca. v članku bomo pokazali, kako uvedba obratne hipoteke kot finančnega instrumenta lahko v slo-venskem pravnem sistemu izboljša socialno varnost starajočega se prebivalstva.
