Predlog ustavnih sprememb in okrepljeni ustavni diskurz
Izvleček
Namen pričujočega članka je osvetliti nekaj značilnosti zapletene
zgodovine ameriškega ustavnega diskurza in ustavne prakse,
obenem pa izpostaviti premalo obravnavano dilemo skozi celotno
obdobje pravne tranzicije pri nas: problem pravnih transplantov.
Doslej se je izkazala kot problematična vrsta hibridnih rešitev iz
obdobja tranzicije, ko smo kombinirali posamezne pravne rešitve
po anglosaksonskem pravnem sistemu, druge pa po različnih bolj
ali manj naključno izbranih evropskih. Pri vseh hibridnih rešitvah
je prevladovalo naivno prepričanje enostavnega prenašanja posameznih
pravnih in institucionalnih rešitev v naš pravni prostor.
Zato zagovarjam premišljen način reševanja pravnih problemov
pri nas, kar vključuje celovitejšo razpravo o institucionalni usposobljenosti,
če želimo ustrezno in uspešno nasloviti ne le sedanji
vse bolj neobvladljivi pripad zadev pred Ustavnim sodiščem, temveč
tudi vrsto drugih pomembnih pravnih vprašanj.
Končno izpostavljam nekaj drugih pomembnih in nezadostno
razpravljanih tem ustavnega prava ter podajam nekaj alternativnih
predlogov, ki bi lahko prispevali h krepitvi ustavnega diskurza
in ustavne demokracije pri nas.
