Prepoved sovražnega govora v sodni praksi Evropskega sodišča za človekove pravice
Izvleček
Pravica do svobode izražanja je eden izmed temeljev svobo-dne, pluralne, strpne in širokosrčne demokratične družbe. ven-dar ta pravica ni absolutna, saj jo je treba varovati v razmerju do drugih vrednot. Članek obravnava in analizira 50 zadev iz sodne prakse Evropskega sodišča za človekove pravice, ki se nanašajo na sovražni govor. Iz analize teh zadev izhaja najmanjši skupni ime-novalec, da svoboda izražanja ne varuje sovražnega govora, ki te-melji na poveličevanju genocida, hudodelstev zoper človečnost in holokavsta ali na diskriminatornih in ksenofobičnih izjavah zoper rasne, verske ali etnične skupine. Članek v sklepu zaključuje, da posamezniki nosijo ključno odgovornost pri ustvarjanju strpnega, svobodomiselnega in pluralnega javnega prostora v vsakokratni evropski družbi.
