Človekovo »dostojanstvo« v ustavnosodni presoji Ustavnega sodišča RS
Izvleček
Ustavno sodišče Republike Slovenije se je s problemom člove-kovega dostojanstva (human dignity, Menschenwürde) soočilo v zanimivi in občutljivi zadevi št. U-I-109/10. Presoditi je moralo ustavnost 2. člena odloka Mestne občine Ljubljana o določitvi in spremembi imen in potekov cest in ulic na območju Mestne obči-ne Ljubljana. zgodovinske in pravno-etične korenine spoštovanja človekovega dostojanstva velja najprej iskati v naravnem pravu, saj spoštovanje človeka kot človeka, torej spoštovanje njegovega člo-veškega dostojanstva, izhaja iz samega bistva človeka. Ker je člo-vek, mu po naravi stvari gre spoštovanje njegovega dostojanstva. Po daljši izčrpni obravnavi je Ustavno sodišče Republike Slove-nije odločilo, da je 2. člen odloka Mestnega sveta Mestne občine Ljubljana v nasprotju s 1. členom Ustave Republike Slovenije in ga odpravilo. Ustavno sodišče je odločitev v tej zadevi sprejelo soglasno, kar ji daje poseben pomen. odločitev je v javnosti razu-mljivo povzročila izjemen odziv. Nekateri so jo označili za zgodo-vinsko, ker je spoštovanje človekovega dostojanstva umestila prav v 1. člen Ustave Republike Slovenije in ga torej utemeljila kot del bistva demokratičnosti.
