Javna oblast – omejitve in izjeme po Pogodbi o delovanju EU
Izvleček
Članek obravnava problematiko izjem glede izvajanja javne
oblasti in zaposlovanja v državni upravi v povezavi s temeljnimi
svoboščinami EU na področju svobode ustanavljanja in prostega
pretoka storitev in delavcev. Članek najprej obravnava pojma »javne
oblasti« iz 51. čl. Pogodbe o delovanju EU (PDEU) in »državne
uprave« iz 4. odst. 45. čl. PDEU, kakor ju je opredelilo Sodišče EU
v svoji sodni praksi. Nato obravnava sodno prakso Sodišča EU s
področja svobode ustanavljanja v povezavi z izjemo glede javne
oblasti po 51. čl. PDEU (na primer zadeve v zvezi s svobodo ustanavljanja
notarjev) in sodno prakso glede prostega pretoka storitev
v zvezi z izjemo glede javne oblasti po 62. čl. PDEU v povezavi
z 51. čl. in 56. čl PDEU (na primer zadevo C-404/05, Komisija/
Nemčija). Slednjič članek obravnava še sodno prakso Sodišča EU
na področju prostega pretoka delavcev v zvezi z izjemo glede zaposlovanja
v državni upravi po 4. odst. 45. čl. PDEU (na primer
zadevo C-460/08, Komisija/Grčija).
