Pilotne sodbe – konstitucionalizacija Evropskega sodišča za človekove pravice?
Izvleček
Prispevek najprej obravnava političnozgodovinske okoliščine,
v katerih se je uveljavila ideja pilotne sodbe, ter s tem povezane
razloge, ki so ESČP prisilili k temu »odkritju«. Razlogi, ki so terjali
uvedbo instituta pilotne sodbe, so pravzaprav enaki smislu tega
instituta: obvladovanje pripada zadev in pomoč državam pri implementaciji
konvencijskih pravic ter s tem učinkovitejše varstvo
pravic. V nadaljevanju so prikazani institucionalni razvoj instituta,
dejanski (praktičen) potek pilotnega postopka ter nekatera nerešena
vprašanja. Prispevek se zaključi s kratko analizo vpliva pilotne
sodbe na razmerje med ESČP in ustavnimi organi obsojene države
pogodbenice (predvsem na razmerje z ustavnim sodiščem)
ter sklepnimi mislimi o dobrih in slabih straneh tega, konvencijsko
neurejenega (in s prakso ESČP vsiljenega) instituta.
