Moderni pogledi in izzivi namenske razlage pravnih aktov: prispevek k teoriji pravne argumentacije

Namenska razlaga pravnih aktov je ena izmed neobveznih metod razlage pravnih aktov. Prispevek jo definira širše od klasič-nega pojmovanja, zaradi česar jo razdeli na teoretična izhodišča, kjer se opredeli do semantičnih in hermenevtičnih temeljev prav-ne razlage interpretacije, ter do štirih podvrst namenske razlage. Obravnava namreč subjektivno namensko razlago, ki določa po-men jezikovnih znakov glede na subjektivni namen avtorja prav-nega besedila; intersubjektivno namensko razlago kot izpeljanko znanstvenega načela intersubjektivnosti; objektivno namensko razlago, ki določa pomen jezikovnih znakov glede na namen ra-zumnega avtorja besedila in namen pravnega sistema; ter končno (ultimativno) razlago kot sintezo in integracijo vseh spoznanj o relevantnih namenih. Posamezni segmenti prispevka so obravnavani v luči namen-skega oziroma purpozivističnega pristopa, ki pojmuje razlago pravnih aktov kot holistično vrednotenje pomenov in namenov pravnega besedila, ter tekstualističnega pristopa, ki v kontrastu zavrača vsakršno špekuliranje glede namenov ter strogo omejuje razlago na pravno besedilo kot edini dopustni vir, iz katerega je mogoče spoznati pomen pravnih norm.
