Uveljavljanje in varovanje javnega interesa z vidika razmerja med javnim in zasebnim
Izvleček
Pojem javnega interesa ter njemu sorodni pojmi imajo v osnovi splošno družbeni pomen, ki ga zaznamujeta osebna in družbena dobrobit. Na tem splošno družbenem pomenu je seveda uteme-ljen tudi pravni pomen pojma javni interes, ki pa je hkrati nujno podrejen vsem bistvenim značilnostim pravnega sistema, zaradi česar ga je potrebno od pojma javnega interesa v splošno druž-benem pomenu tudi razločevati. Kot bistveni kriterij tega razlo-čevanja bi lahko navedli kvalitativni kriterij, ki je utemeljen na na-čelu pravne države. Ta kriterij pa deluje v obe smeri. Po eni strani preprečuje, da bi se zaradi nekih, v družbeni skupnosti večinsko zastopanih interesih, zapostavljalo ali celo zatiralo manjšinsko za-stopane interese, po drugi strani pa preprečuje tudi oblastniško samovoljo pri oblikovanju pravnega pojma javnega interesa. Prav-ni pojem javnega interesa se mora v okviru moderne demokratič-ne in pravne države tako oblikovati na način, da se v temeljnem ne odmika od, na demokratičnih osnovah izraženega, splošnega družbenega interesa, hkrati pa mora ta interes presegati v tem smislu, da zasleduje dobrobit vsakega posameznika kot subjekta družbene skupnosti, s čimer pojem javni interes kot pravni pojem tudi sam postane kvalitativni kriterij družbenega urejanja ter upra-vljanja in kot tak tudi bistven element načela pravne države.
