Upravljanje migracij v Evropski uniji: realističen pristop Sodišča Evropske unije do turških državljanov
Izvleček
Članek obravnava tematiko priseljevanja državljanov tretjih držav v EU s poudarkom na posebnem položaju turških drža-vljanov. Na tem področju je namreč EU pod pritiski zelo kom-pleksnih in nasprotujočih si sil, zaradi katerih je EU prisiljena vzpostavljati določena ravnotežja. Avtorici v članku ugotavljata, da je za turške državljane nedavna zadeva Demirkan pomenila upanje na odprtje meja med EU in Turčijo. Če bi Sodišče pritr-dilo tožničinim zahtevam in dovolilo varstvo turškim prejemni-kom storitev, bi slednji lahko prosto prestopali meje EU, saj je nemogoče vršiti nadzor nad slehernim posameznikom, ki bi s tem dobil moč, da se v katerikoli situaciji sklicuje na možnost prejema neke storitve. Nenaklonjenost držav EU tej rešitvi je pri odločitvi Sodišča odigrala ključno vlogo. Strah pred množič-nim priseljevanjem, spremembo kulturne in religiozne podobe EU in vdor turških državljanov na trg dela je usidran v misel-nosti cele Evrope in nerealno je pričakovati, da si bo kaj kmalu premislila in Turčiji dovolila vstop v EU, pa naj bo to na podlagi sporazuma ali polnopravnega članstva v EU. Tako ni presene-tljiva odločitev, da je Sodišče postavilo mejo priseljevanju tur-ških državljanov v EU, ko bi to potekalo na temelju prostega prejemanja storitev.
