Konsolidiranje demokracije s pomočjo tranzicijskega pravosodja v Sloveniji: Smo se česa naučili?

V mesecih po koncu druge svetovne vojne 8. maja 1945 je bilo v Sloveniji po ocenah po hitrem postopku usmrčenih kar 130.000 ljudi. Članek najprej na kratko opiše dejansko ozadje zločinov, stor-jenih na slovenskem ozemlju po drugi svetovni vojni. Nato obrav-nava razsodbe slovenskih okrožnih in višjih sodišč v sodnem pri-meru proti nekdanjim funkcionarjem totalitarnega režima. Članek potem analizira razsodbe s stališča mednarodnega kazenskega pra-va in tranzicijskega pravosodja ter poskuša iz tega črpati spoznanja v zvezi z razumevanjem trenutnih ideoloških delitev v Sloveniji. Na temelju tega znanja članek dokazuje, da obstajajo močni pravni in moralni temelji za sodni pregon zločinov proti človečnosti, storjenih v Sloveniji po drugi svetovni vojni. Čeprav se trenutna situacija v Slo-veniji zdi slaba, se zdi, da narašča konsenz za smiselno in nadaljnjo reformo, ki bi uredila vprašanje povojnih pobojev in skritih množič-nih grobišč žrtev na način, ki bo spoštoval pravico žrtev do imena in groba ter okrepil trenutno stanje demokracije v Sloveniji.
