Analiza sodbe Sodišča Evropske Unije v zadevi Google Spain SL in Google Inc. proti Agencia Española de Protección de Datos (AEPD) in Mario Costeja González
Izvleček
v prispevku predstavljam sodbo Sodišča EU C 131/12, izdano v postopku predhodnega odločanja, s katero je Sodišče razlagalo Direktivo s področja varstva osebnih podatkov. Pri tem je zavze-lo stališče, da gre pri dejavnosti spletnih iskalnikov za obdelavo osebnih podatkov, družbe, ki upravljajo spletne iskalnike, pa se štejejo za upravljavce takih podatkov. Slednje izvajajo obdelavo osebnih podatkov tudi, kadar imajo sedež v tretji državi in poslov-no enoto v državi članici, v kolikor ima poslovna enota v namenu tržiti in prodajati oglasni prostor na iskalniku. Bistvo obravnavane sodbe je predvsem v tem, da je z njo Sodišče omogočilo pravno podlago pravici do pozabe. Direktiva tako omogoča pravico do izbrisa osebnih podatkov zainteresirane osebe s seznama zadet-kov iskanja v spletnem iskalniku, pri čemer se tehta med njeno pravico ter gospodarskimi interesi upravljavca iskalnika in intere-si internetnih uporabnikov, da do teh podatkov dostopajo. Slednje lahko prevladajo le v izjemnih okoliščinah, kot je na primer vloga posameznika v javnem življenju. Sodišče je pri tem še dodalo, da omenjena pravica ni pogojena s povzročitvijo škode zainteresira-ni osebi, s predhodnim ali sočasnim izbrisom podatkov iz spletne strani, na kateri se ti nahajajo, in tudi ne s samo zakonitostjo obja-ve podatkov na tej spletni strani.
