Izkušnje ESČP pri odpravi sodnih zaostankov
Izvleček
Prispevek obravnava preobremenjenost sodišč in sodne zao-stanke z vidika prakse Evropskega sodišča za človekove pravice (ESČP). Avtorica prikaže razvoj prakse ESČP v zvezi z dolžinami postopkov od splošnih kriterijev, ki jih ESČP uporablja pri odlo-čanju in ki so se razvili v preteklosti, preko prelomne odločitve v zadevi Kudla proti Poljski, v kateri je sodišče prvič ločeno obrav-navalo procesno jamstvo sojenja v razumnem roku iz 6. člena ter zahtevo po učinkovitem pravnem sredstvu iz 13. člena Evropske konvencije o varstvu človekovih pravic in temeljnih svoboščin (EKČP), do t. i. pilotskih oziroma pilotskim sodbam podobnih sodb in njihovih učinkov na primeru Slovenije. ob tem ugotavlja, da se delež obsodb pred ESČP zaradi dolžin postopkov manjša, kar je po njenem mnenju tudi posledica odziva ESČP na struktur-ne probleme v obliki t. i. pilotskih sodb.
